My Story:
My husband of 36 years wants a no fault divorce. He has lived in another city for over two years now and he sought a paralegal for advise. I live paycheck to paycheck and can not afford an attorney. He tells me he wants $25,000 from the sale of our home and property and if we sell I have no place to go. I work and live in a small town with one stop light and jobs are not that easy to come by. I am deeply rooted here so packing up and relocating is not an option right now. The property and my 401K are my biggest issues. The property is maybe worth $70,000. After giving him $25,000 I will not have enough to purchase a home here. I am five years away from retirement and really can't afford to buy him out by getting a personal loan.
If I do the no fault divorce can the judge grant him part of my 401 K even though he says he doesn't want any of it and can the judge give him more from the sale of the property? I need major help...thanks
